Legal Briefs - Compensation For Work Related Injuries
In order to ensure that injured workers receive compensation as expeditiously as possible, workers’ compensation laws require employers to compensate employees who are injured during the course of their employment. Unlike a personal injury case, workers’ compensation laws do not require injured employees to prove that their employers caused their injuries. As a result, recovering money for work-related injuries under the worker’ compensation process is easier. On the other hand, injured workers are not likely to recover as much money as they would in the typical personal injury lawsuit. In addition, in as much as injured workers are prohibited from suing their employers, they may still sue third parties who may have negligently contributed to (or caused) the injury.

Worrying about whether you will receive enough benefits to cover your medical expenses and lost wages can exacerbate the stress of recovering from your job accident or injury. After what can seem like an eternity of delay, an injured employee may benefit from hiring legal counsel. A Worker’s Compensation attorney may file a motion to compel the Workers’ Compensation insurance carrier to comply with the legal requirements of promptly admitting or deny the employee’s claim to benefits.

HINT: If you are injured at work but someone outside your company caused the accident, consult an attorney about suing the third party (who can also be sued if your employer does not carry workers’ compensation insurance.)
